ARTICLE 1 – PURPOSE AND DEFINITIONS

These General Terms and Conditions of Sale organize the online sales service for products available in catering establishments under the “CHEZ LEON FAST-FOOD” brand, the GALERIE BIZOU BIZOU and the Restaurant Léon Hôtel participating and accessible via the website www. leonhotel-kinshasa.com.

These General Conditions of Sale (the “GTC”) apply to any sale (hereinafter “the Sale”) of one or more products (the “Products”) concluded by the Customer (the “Customer”) on the commercial site www.leonhotel-kinshasa.com. (the “Site”) with participating catering establishments under the “CHEZ LEON FAST-FOOD” brand, GALERIE BIZOU BIZOU and Restaurant Léon Hôtel (the “Seller”).

These T&Cs shall prevail over any other general or specific conditions not expressly approved by the Seller.

Within the framework of these general conditions of sale,

The “Seller” designates the natural or legal person operating a catering establishment under the name “CHEZ LEON FAST-FOOD”, the GALERIE BIZOU BIZOU and the Restaurant Léon Hôtel and to which the Customer’s order will be addressed. The contact details of this person will be specified to the Customer on the order confirmation email and on the receipt provided by the Seller at the time of collection or delivery of the Products.

· The term “Sale” refers to the online ordering service for Products available in participating catering establishments and accessible via the site www.leonhotel-kinshasa.com The Customer will withdraw his order from the catering establishment which will be indicated to him or obtain delivery to the designated place and pay for the order.

ARTICLE 2 – MINORS CUSTOMERS

Online sales on the Site are reserved for Customers who are at least 13 years old on the date of conclusion of the Sale.

In accordance with the provisions of Public Health, the sale of alcohol to minors under the age of eighteen (18) is prohibited. Consequently, the purchase of any alcohol-based product during the Sale is strictly prohibited for minors under the age of eighteen (18). An identity document may be requested from the Customer when collecting or delivering the Products.

ARTICLE 3 – ACCEPTANCE OF THE T&Cs

The applicable T&Cs will be those appearing on the Site on the date of the Sale. The Customer declares to have read and accepted these GCS by ticking the box “I have read and accept the general conditions of sale” before the validation and conclusion of the Sale.

Any order of a product on the site therefore materializes on the part of the Customer the acceptance of these GCS.

ARTICLE 4 – PRODUCTS

The Products offered are those that appear on the Site on the day of the Sale, within the limits of available stocks. These Products are subject to change or discontinuation without notice. The photographs and illustrations presented on the Site are not contractual.

The products sold must be consumed quickly from their collection in store or their delivery and must not be frozen.

ARTICLE 5 – PRICE

The Seller reserves the right to modify its prices at any time, it being understood that the price appearing on the site on the day of the sale will be the only one applicable.

The prices listed on the Site are inclusive of VAT (all taxes included), in dollars, taking into account the VAT applicable on the day of the Sale.

ARTICLE 6 – CREATION OF AN ACCOUNT

To conclude a Sale, the Customer creates a personal account which lists the history of Sales to the Customer.

When creating the Account, the Customer chooses a username and password associated with a valid email address.

Certain mandatory data is requested from the customer, in particular: his surname, first name, date of birth, postal and electronic address and mobile phone number.

The username and password remain personal to the Customer and the Seller cannot be held responsible for any fraudulent use of the Customer’s account by a third party.

If the password is forgotten, the Customer may request a reminder e-mail to the e-mail address indicated.

It is the Customer’s responsibility to keep his information strictly confidential and not to communicate it to third parties, in order to avoid as far as possible any risk of intrusion into his Customer account and the placing of Orders without his knowledge by unauthorized persons. The Seller cannot be held responsible for any use of the Customer account by a third party who has had access to his username and password in any way whatsoever.

ARTICLE 7 – CONCLUSION OF SALES

The Sale concluded by the Customer takes place as follows:

  1. Login to www.leonhotel-kinshasa.com
  2. Selection of the catering establishment for the collection or delivery of the Products
  3. Filling the basket and validation
  4. Creation of the personal or connected account
  5. Choice of method of withdrawal of goods
  6. Verification of the Order
  7. Acceptance of the T&Cs
  8. Sending of the order and confirmation
  9. Sending of a confirmation e-mail or SMS containing the references of the Sale.
  10. Withdrawal of the Products from the catering establishment during the opening hours which will be indicated to it at the time of the order and or Delivery to the address specified by the Customer.

ARTICLE 8 – DELIVERY

The CUSTOMER has the option of placing an order at any time. Deliveries will be made during store opening hours and no earlier than 45 minutes after store opening.

A delivery time is indicated to the CUSTOMER when confirming the order. This deadline is communicated for information purposes. It has no contractual value. Failure to comply does not engage the responsibility of the catering establishment concerned.

Delivery is made to the CLIENT’s home, as mentioned when placing the order. In the event of an error in the wording of the CLIENT’s contact details, the catering establishment concerned cannot be held responsible for the impossibility in which it finds itself to deliver the order.

The CUSTOMER has the option of withdrawing his order directly from the catering establishment concerned. The store’s contact details are sent to it when the order is validated on the site and on the confirmation email.

VERY IMPORTANT :

Any withdrawal or delivery can only be made after presentation of the order references indicated on the confirmation email or SMS and after payment of the price. The catering establishment will then issue a receipt to the Customer.

ARTICLE 9 – ARCHIVING

The Seller will archive sales and invoices on a reliable and durable medium, constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

ARTICLE 10 – CANCELLATION AND MODIFICATION

Any order that has been validated, paid for and withdrawn cannot be cancelled.

No merchandise will be taken back or exchanged.

Any order placed on the Site is firm and definitive and cannot be canceled or modified.

The right of withdrawal applicable to distance selling is excluded in the event of the supply of goods which, by their nature, are likely to deteriorate or expire rapidly.

ARTICLE 11 – COMPLAINTS

Any complaint concerning the Sale will be sent to the Seller within a maximum period of forty-eight (48) hours after the collection or delivery of the Products, by registered mail with acknowledgment of receipt, to the address of the catering establishment appearing on the receipt. At the end of the period, no complaint can be taken into account.

Any complaint about the operation of the Site will be sent by registered mail with acknowledgment of receipt to the following address:

ARTICLE 12 – EXCLUSION OF LIABILITY

The Seller is only bound by an obligation of means in the online sales process.

The Seller is not responsible for the risks relating to the use of the Internet network (loss of data, intrusion, virus, etc.).

ARTICLE 13 – PROTECTION OF PERSONAL DATA

For the purposes of this article, the Seller designates in the DRC: the company MILTEX SARLU, all the subsidiaries controlled by the company MILTEX SARLU as well as all the natural or legal persons franchised by MILTEX SARLU.

Via the online ordering site, the Seller collects personal data, such as surnames and first names, postal and electronic addresses, mobile phone number, submitted by the Customer for commercial purposes and in particular to involve him in promotional operations. or advertising.

The Seller shares this personal data only on French territory with the various structures having capital or contractual links with him within the framework of CHEZ LEON FAST-FOOD, the GALLERY BIZOU BIZOU and the Restaurant Léon Hôtel and defined in the first paragraph of the this article.

The Seller may request service providers to carry out various tasks, in particular tasks of a commercial nature such as the execution of orders, assistance with promotional campaigns, the provision of technical services for websites, etc. These service provider companies have access to personal data if this is necessary for the performance of their services and cannot use this data outside the performance of these services. These companies undertake to comply with the legislation on the collection and processing of personal data.

The Seller does not sell, assign or communicate any personal data to third parties.

In the event that the Seller is forced, to comply with an administrative, legal or judicial decision, to communicate to an authorized third party, to files and freedoms, information relating to the personal data filed and processed that it holds, he undertakes, prior to any communication, to inform the persons concerned.

The Customer has the right to access and rectify information concerning him. If the customer wishes to exercise this right, obtain information concerning him or oppose the processing of his personal data, he should contact MILTEX SARLU, Consumer Service, 67, avenue du Commerce Gombe Kinshasa RD CONGO.

ARTICLE 14 – INDIVISIBILITY

The nullity of one of the clauses of this contract in application in particular of a law, a regulation or following a court decision will not entail the nullity of these GCS.

ARTICLE 15 – APPLICABLE LAW

These T&Cs are subject to the laws of the Democratic Republic of Congo.

ARTICLE 16 – COMPETENT JURISDICTION

In the event of a dispute, the competent Court is designated by the rules of common law.
